Former Director of Overture Center Pleads Guilty to Mail Fraud and Tax Evasion

Madison, Wisconsin—Erik C. Peterson, United States Attorney for the Western District of Wisconsin, announced that Robert D'Angelo, 63, of Madison, pleaded guilty today in U.S. District Court in Madison. D'Angelo pleaded to one count of mail fraud which alleged that he had devised and participated in a scheme to defraud the City of Madison of his honest services. D'Angelo also pleaded guilty to filing a materially false 2004 federal income tax return with the Internal Revenue Service.

On October 10, 2007, a federal grand jury sitting in Madison returned an indictment against D'Angelo. The indictment charged D'Angelo with mail fraud, wire fraud, filing false federal income tax returns, and money laundering. The mail and wire fraud counts alleged that D'Angelo defrauded the City of Madison by operating two side businesses from his City office, using City resources including his office computer, office employees, office supplies and equipment, and office storage facilities. The indictment also alleged that D'Angelo filed false income tax returns for the years 2001 through 2004.

Chief U.S. District Judge Barbara B. Crabb scheduled sentencing for April 22, 2008, at 1:00 p.m. As to the mail fraud charge, D'Angelo faces a statutory maximum penalty of 20 years in prison and a $250,000 fine. On the false tax return count, D'Angelo faces a statutory maximum penalty of three years in prison and a $250,000 fine.

The charges against D'Angelo were the result of a joint investigation conducted by the Madison Police Department, the Internal Revenue Service-Criminal Investigation Division, the U.S. Postal Inspection Service, and the Federal Bureau of Investigation. The prosecution of the case has been handled by Assistant United States Attorney Daniel J. Graber.
